1. About these terms
1.1 These terms apply to every order placed on www.landregistryonline.ie. They explain who we are, what we do, your right to cancel, what happens if something goes wrong and how to complain. Please read them before you order.
1.2 You will be asked to accept these terms at checkout. We will email you a copy with your order confirmation, so please keep it for your records.
1.3 These terms are available in English only.
2. Who we are and how to contact us
2.1 We trade as Land Registry Online.
2.2 You can contact us by email at info@landregistryonline.ie. We aim to reply within one working day.
2.3 If we need to contact you, we will do so by email or phone using the details you gave us with your order. When we say "in writing" in these terms, this includes email.
3. We are an independent service
3.1 We are a private, independent document retrieval, search and consultancy service. We are not Tailte Éireann, the Land Registry, the Registry of Deeds or any Government department or body. We are not affiliated with, endorsed by or acting on behalf of any of them.
3.2 You can obtain copies of folios and title plans directly from Tailte Éireann at www.tailte.ie for the official fee only. Our price is higher because it includes our own search, identification, checking and customer support service in addition to the official fee.
4. Our services
4.1 Depending on what you order, we will:
4.2 Where a document is only available as a certified or paper copy, we will request it for you and it will be sent by post. We will tell you if this applies to your order.
4.3 The information in the documents comes from the official register. We do not create or alter it, and we are not responsible for any error or omission in the register itself.
4.4 Title plans in Ireland are not conclusive as to boundaries. They show the approximate position of a property and do not fix its exact boundaries or extent. If you need exact boundaries, please speak to a solicitor or a surveyor.
4.5 We do not give legal advice. Our documents and any guidance we give you are for information only. For advice about a purchase, a sale or a dispute, please speak to a solicitor.
5. Placing an order
5.1 You must be 18 or over to place an order.
5.2 You must give us accurate and complete property details. If they appear wrong or incomplete, we will contact you to check them.
5.3 If you place an order for or on behalf of another person or a business, you confirm that you are authorised to do so.
5.4 Your order is an offer to buy our services. A contract between you and us is formed when we email you our order confirmation after your payment has been taken.
5.5 We may decline an order, for example if there is an obvious error in the price or description, if we cannot identify the property, or if we reasonably suspect fraud or misuse. If we decline your order we will tell you and refund you in full.
5.6 Our services relate to property in Ireland, but you can order from anywhere. Digital documents are delivered by email.
6. Prices and payment
6.1 Prices are shown in euro and include VAT where applicable. The price you pay is the total shown at checkout before you confirm your order, and it includes the official Tailte Éireann fee for the documents ordered.
6.2 You pay in full when you place your order, using one of the payment methods shown at checkout. Card payments are processed securely by Stripe and PayPal. We do not see or store your full card details.
6.3 If we discover an obvious pricing error before your order is completed, we will contact you. You can then choose to go ahead at the correct price or cancel for a full refund.
7. Timescales
7.1 We aim to email digital documents within 24 hours of your order on working days (Monday to Friday, excluding Irish public holidays). Any faster processing options and their timescales are shown at checkout.
7.2 Timescales are estimates. Sometimes Tailte Éireann's systems are unavailable, or a folio is temporarily locked while an application is being processed. These delays are outside our control, but we will tell you as soon as we know and keep you updated.
8. Your right to cancel
8.1 As a consumer, you have the right under the Consumer Rights Act 2022 to cancel your contract within 14 days of the day the contract is formed, without giving any reason.
8.2 Most customers need their documents quickly, so at checkout you can ask us to start work on your order straight away, during the 14-day cancellation period. If you make that request:
8.3 To cancel, email info@landregistryonline.ie with your name and order number, or send us the model cancellation form at the end of these terms. You do not have to use the form. It is enough that you send your cancellation before the cancellation period ends.
8.4 We will confirm receipt of your cancellation by email. We will refund you without undue delay, and in any event within 14 days of being told of your cancellation, using the same payment method you used, unless you agree otherwise. You will not be charged a fee for the refund.
8.5 The right to cancel applies to consumers only. It does not apply if you order for business purposes.
9. If a document does not exist or cannot be obtained
9.1 Some land in Ireland is not registered in the Land Registry. Its title is recorded in the Registry of Deeds instead, so there is no folio or title plan to supply. A folio may also be temporarily unavailable, for example while an application to change the register is pending.
9.2 If we find that the property is unregistered, or we cannot obtain the document you ordered, we will tell you by email and refund you in full.
9.3 If a document is only temporarily unavailable, we will offer to wait and send it to you once it becomes available, or to refund you on the basis in clause 9.2.
9.4 If we cannot identify the property because the details you gave us are wrong or incomplete, we will ask you for the missing information. If you do not reply within 30 days of our request, we will close your order and refund you on the basis in clause 9.2.
10. If something goes wrong
10.1 We must provide our services with reasonable care and skill, as described to you and within a reasonable time. Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2022.
10.2 If we send you the wrong document, or a document that does not match your order because of our mistake, please tell us. We will put it right at no cost to you. If we cannot do so within a reasonable time, or the problem is serious, you are entitled to a proportionate price reduction or to end the contract and receive a refund.
10.3 Any refund due under this clause will be paid within 14 days of your decision to end the contract or to take a price reduction, using the same payment method you used.
11. Changes to our services and ending the contract
11.1 We may make minor changes to our services to reflect changes in the law or to make technical improvements, where these do not affect your order.
11.2 If we have to stop providing a service you have ordered, we will tell you as soon as possible and refund anything you have paid for services you will not receive.
11.3 We may end your order if we reasonably believe it is fraudulent or is being used to harass or harm another person. If we do, we will refund anything you have paid for work we have not carried out.
12. Our responsibility to you
12.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen, or if both of us knew it might happen when the contract was formed.
12.2 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under Irish law, including your statutory rights as a consumer.
12.3 If you use our services for business purposes, we will not be liable for any loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability to you is limited to the price you paid for the order concerned.
13. Your personal data
13.1 We use your personal data as explained in our Privacy Policy and Cookies Policy.
14. Complaints
14.1 If you are unhappy with our service, please email info@landregistryonline.ie with your order number and a short description of the problem. We will acknowledge your complaint within 2 working days and aim to resolve it within 5 working days.
14.2 If you are not satisfied with our response, information about your consumer rights is available from the Competition and Consumer Protection Commission at www.ccpc.ie. You may also be able to bring a claim through the Small Claims procedure of the District Court (www.courts.ie).
14.3 We do not currently subscribe to an alternative dispute resolution scheme.
15. Other important terms
15.1 We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens and it will not reduce your rights. You may only transfer your rights under these terms with our written agreement.
15.2 If a court decides that any part of these terms is unlawful or unenforceable, the rest of these terms will continue in full force.
15.3 If we do not insist straight away on something you are required to do under these terms, that does not stop us insisting on it later.
15.4 We may update these terms from time to time. The version in force when you place your order is the one that applies to that order.
16. Governing law and courts
16.1 These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction over any dispute.
16.2 If you are a consumer living in another EU member state, you keep the protection of the mandatory consumer laws of that country and you may bring proceedings there.
